Mello Tabs LLC · 4711 Hope Valley Rd, Ste 4F 421 · Durham, North Carolina 27707
These Terms of Use and Sale (“Terms”) are an agreement between Mello Tabs LLC, a North Carolina limited liability company (“Mello Tabs,” “we,” “us,” or “our”), and each person who visits mellotabs.com or any site that links to these Terms (the “Site”) or who buys our products through the Site (“you”). The Shipping Policy, the Refund and Return Policy, and the Privacy Policy are part of these Terms and are incorporated by reference. Wholesale purchases are governed by our separate Wholesale Terms, not by these Terms.
Please read these Terms before you use the Site or place an order. You accept these Terms by using the Site, and you accept the version in effect at checkout by checking the acceptance box before you pay. If you do not agree, do not use the Site or place an order.
1. Age and eligibility
The Site and the products sold on it (the “Products”) are offered only to individuals who are at least 21 years of age, or the higher minimum age required by the law of the shipping destination. By using the Site, placing an order, or accepting delivery, you represent that you meet this requirement and that the recipient of any order does as well. We may require an adult signature at delivery, may use age- or identity-verification services on any order, and may cancel and refund any order we are unable to verify. Providing false information about age is a breach of these Terms. You also represent that you are legally capable of entering into a binding agreement and, if you use the Site for a business, that you have authority to bind that business.
2. Where we ship
We ship only to addresses in the United States, and we do not ship to destinations on our Prohibited Destinations List, which we maintain state by state (and, where necessary, by postal code) based on the law of each destination. Checkout declines addresses in prohibited destinations; if an order to a prohibited destination is placed anyway, we cancel it and refund your payment in full before shipment. The list changes as state laws change. Our Shipping Policy has the details.
3. About the Products
Our Products are chewable tablets and capsules made with cannabidiol (CBD) and cannabigerol (CBG) isolate derived from hemp. Each batch is tested by an independent, ISO/IEC 17025-accredited laboratory, and each container carries a lot number that links it to that batch’s Certificate of Analysis. Our Products are made only from cannabinoids that occur naturally in hemp and are obtained by extraction and purification; they contain no cannabinoid synthesized outside the plant or made by chemically converting another cannabinoid, and no detectable THC of any kind at the laboratory’s lower limit of quantitation. They are produced from hemp as defined by federal law, including the definition as amended by Section 781 of Public Law 119-37 and the effective dates set by Congress for that amendment.
Our Products are not marketed as dietary supplements, medicines, or drugs. Statements on the Site have not been evaluated by the U.S. Food and Drug Administration. Our Products are not intended to diagnose, treat, cure, or prevent any disease. Consult a qualified healthcare professional before using this product if you are pregnant, nursing, taking medication, or have a medical condition. Keep out of reach of children.
4. No medical advice
Information on the Site — product descriptions, articles, answers to questions, and customer communications — is provided for general information only and is not medical advice. Nothing on the Site is a substitute for the advice of a qualified healthcare provider, and nothing on the Site should be read as a claim that any Product treats or relieves any condition or symptom.
5. Orders, pricing, and payment
Order acceptance. Your order is an offer to buy. We accept it when we ship the Products, and our order confirmation email is an acknowledgment, not an acceptance. We may decline or cancel any order in whole or in part before shipment — for example, if a Product is unavailable, if the shipping address is a prohibited destination, if we cannot verify age or payment, or if we suspect fraud — and if we do, we will refund any amount you have paid for the canceled portion.
Pricing errors. If a Product is listed at an incorrect price or with incorrect information because of a typographical or system error, we may cancel any order placed at that price and refund it, even after the order confirmation has been sent.
Quantity limits. We may limit the quantity of any Product purchased per order, per customer, or per address, and we may refuse orders that appear to be placed for resale in violation of these Terms or of applicable law.
Payment. You must provide accurate, complete, and current payment information. By submitting it you authorize us and our payment processors to charge the total shown at checkout, including shipping and any applicable taxes. Prices and availability may change without notice, but a change does not affect an order we have already accepted.
Cancellation. You may cancel an order at no charge at any time before it ships by contacting us; once an order has shipped, the Refund and Return Policy applies.
6. Billing questions and disputes
If you have a question about a charge, please contact us first so we can resolve it quickly — most issues are fixed the same day. Nothing in these Terms limits any right you have under the Fair Credit Billing Act, the Electronic Fund Transfer Act, or the rules of your card network to dispute a charge with your bank or card issuer. If a dispute is decided in our favor because the charge was valid, we may recover the third-party processing and dispute fees we incurred, and we may decline future orders from a customer who initiates disputes we reasonably determine to be abusive.
7. Disclaimer of warranties
Except as expressly stated in the Refund and Return Policy, the Products and the Site are provided “as is” and “as available.” To the fullest extent permitted by law, Mello Tabs disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not offer a written warranty or guarantee on any product. Some states do not allow the exclusion of implied warranties, so some of the above may not apply to you.
8. Limitation of liability
To the fullest extent permitted by law, Mello Tabs and its members, managers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to the Site, these Terms, or any order, and our total liability for any claim relating to an order will not exceed the amount you paid for that order.
This limitation does not apply to, and nothing in these Terms limits or excludes: (a) liability for personal injury caused by a Product; (b) liability for our gross negligence, willful misconduct, or fraud; (c) any remedy available to you under N.C. Gen. Stat. § 75-1.1 or any other consumer-protection law; or (d) any other liability that cannot be limited under applicable law.
9. Your responsibility for your own conduct
You agree to defend and indemnify Mello Tabs against claims and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your unlawful use of the Site or the Products, or your violation of another person’s rights. This obligation does not extend to claims arising from our own acts or omissions.
10. Reviews and other content you submit
If the Site allows you to post reviews, comments, questions, or other content (“User Content”), the following applies. You keep ownership of your User Content and grant us a non-exclusive, royalty-free, worldwide license to display and reproduce it in connection with operating and promoting the Site, with attribution to the name you post under. You represent that you have the right to post it and that it does not violate any law or anyone’s rights.
Honest reviews. Nothing in these Terms restricts your right to post an honest review of your experience, positive or negative, and we will not penalize you for doing so. We moderate even-handedly: we remove only content that is unlawful, off-topic, infringing, abusive, deceptive, or that makes health or medical claims about a Product, and we apply the same standard to favorable and unfavorable content. We do not post fake reviews, and we do not suppress negative reviews.
Health claims in reviews. Because a customer statement that a Product treats, relieves, or prevents a condition or symptom becomes a claim by us when we publish it, we do not publish reviews or testimonials that make such statements. This is a rule about what we publish, not about what you may say elsewhere.
Incentivized reviews. If we ever offer anything of value for a review, we will say so, and the review will be labeled as incentivized.
11. Your use of the Site; our content
Subject to these Terms, we grant you a limited, revocable, non-transferable license to use the Site for its intended purposes. The Site and its content — text, images, product names, and design — belong to Mello Tabs or its licensors and are protected by intellectual-property law; you may not copy, scrape, or reuse them except as these Terms allow. You may not use the Site in any way that is unlawful, interferes with its operation, or attempts to bypass its age gate, address validation, or security. The Site may link to third-party sites we do not control and are not responsible for. We may change, suspend, or discontinue any part of the Site at any time.
12. Accounts
If you create an account, you agree to provide accurate information, keep your credentials confidential, and accept responsibility for activity under your account. Tell us immediately if you become aware of unauthorized access. We may suspend or close accounts that violate these Terms.
13. Email and text messages
We send transactional messages (order confirmations, shipping notices, and customer-service replies) to the contact details you give us. If you opt in to marketing emails, every message will include an unsubscribe link, and we honor unsubscribe requests within ten business days. We send marketing text messages only if you separately give prior express written consent to receive them — checking a box that is not required to make a purchase — and you may opt out at any time by replying STOP; reply HELP for help. Message and data rates may apply.
14. Accessibility
We are working to make the Site accessible to people with disabilities and target conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you have difficulty using any part of the Site, contact us at [email protected] and we will help you complete your order and address the issue.
15. Privacy
Our Privacy Policy explains what information we collect, how we use it, and the choices you have. It is part of these Terms.
16. Changes to these Terms
We may update these Terms. Changes apply prospectively: a new version takes effect for new orders on its effective date, and the version you accepted at checkout continues to govern any order you already placed. If we make a material change, we will post a notice on the Site and, for customers with an account or an order on file, email the address we have, at least 15 days before the change takes effect. We keep prior versions and their effective dates and will provide the version that governed your order on request.
17. Governing law and disputes
These Terms and any dispute arising out of them or out of your use of the Site or purchase of Products are governed by the laws of the State of North Carolina, without regard to conflict-of-laws rules. Any legal action must be brought in the state or federal courts located in Durham County, North Carolina, and you consent to their jurisdiction, except that you may bring a claim in the small-claims court of the county where you live if it qualifies. Before filing any claim, please contact us; most problems can be solved directly.
18. General
These Terms, with the policies they incorporate and your order confirmation, are the entire agreement between you and Mello Tabs about the Site and your orders. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of our business. You agree to receive communications from us electronically and that electronic records and signatures satisfy any requirement that a communication be in writing, consistent with the federal E-SIGN Act and the North Carolina Uniform Electronic Transactions Act.
