At Mello Tabs LLC (“we,” “our,” or “us”), we value the privacy of individuals who use our website and related services (collectively, our “Services”). This Privacy Policy explains how we collect, use, share, and retain personal information of users of our Services (“users,” “you,” or “your”). Our Services are offered to residents of the United States only. This Privacy Policy is incorporated into and subject to our Terms of Use and Sale (for consumer customers) and our Wholesale Terms (for wholesale customers).

Personal information is information that identifies or could reasonably be used to identify a specific person. It does not include deidentified, anonymized, pseudonymized, or aggregated information derived from personal information.

1. Information we collect

Information you provide to us

Account and registration information. If you create an account, apply for a wholesale account, subscribe to emails, or otherwise register to use our Services, we may collect contact information such as your name, email address, phone number, business name, business address, and mailing address, and information necessary to verify your eligibility to purchase our products.

Age attestation and verification information. Every order requires you to confirm that you and the recipient are 21 or older. We record that attestation with the order (the text you accepted, the date and time, and the order number). For orders to certain states, or where we have reason to verify age, we may use an identity-verification service, which may collect your name, address, and date of birth and, if database verification fails, an image of a government-issued ID. We use this information only to confirm eligibility and to evidence compliance, we retain it only as long as needed for that purpose, and we do not use it for marketing.

Communications. If you contact us directly, we may collect your name, email address, mailing address, phone number, and the contents of your message or attachments.

Orders and payment information. If you place an order, we or our third-party payment processors may collect billing address, payment card information, ACH information, and transaction details. Payment card information is processed by payment processors that operate under the Payment Card Industry Data Security Standard; we do not store full payment card numbers.

Business information. Because we sell to wholesale customers, we may collect business license information, resale certificates, tax identification numbers, and business ownership details. This information is collected solely for verification and compliance purposes and receives the same security protections as other personal information we hold.

Job applications. If you apply for employment with us, we may collect your name, phone number, email address, employment history, education history, references, and other information in your application materials.

Information we collect automatically

Device information. Information about the device you use to access our Services, including IP address, browser type, operating system, device identifiers, and referring URLs.

Usage information. Information about how you interact with our Services, such as pages visited, time spent on pages, links clicked, search queries, and session information.

Cookies and tracking technologies. We and our third-party partners may use cookies, pixels, and similar technologies to collect information about your interactions with our Services. See “Cookies and tracking” below.

Information we receive from third parties

We may receive information about you from analytics providers, payment processors, shipping carriers, marketing partners, fraud-prevention services, and, where used, identity-verification services. This information helps us provide our Services and protect against fraud.

2. Categories of personal information, purposes, and retention

• Identifiers (name, email, phone, address) — account management, order fulfillment, communications. Retained for the duration of your customer relationship and up to 5 years thereafter for legal and tax compliance.
• Commercial information (order history, transaction records) — order processing, fraud prevention, business records. Retained up to 7 years for tax and legal compliance.
• Age attestation and verification information — eligibility confirmation and compliance records. Attestation records are retained with the order for 4 years; verification results are retained only as long as needed to evidence compliance, and ID images are deleted once verification is complete unless a longer period is required by law.
• Financial information (billing address, payment method type) — processed by third-party payment processors. We do not store full payment card numbers.
• Business credentials (resale certificates, tax IDs, licenses) — wholesale account verification and regulatory compliance. Retained for the duration of the wholesale relationship and as required by law.
• Internet and network activity (IP address, browser type, usage data) — site analytics, security, and improvement. Retained up to 24 months.
• Employment application information — retained up to 2 years for applicants not hired; longer for employees as employment law requires.

We do not sell personal information for monetary consideration. To the extent we share personal information with advertising or analytics partners (as described below), that sharing may be “sharing” under California law. See “California resident rights” for opt-out options.

3. How we use the information we collect

4. Advertising and analytics

We may work with third-party analytics and advertising partners to understand how users interact with our Services and to deliver relevant advertising. These partners may use cookies or similar technologies to collect information about your interactions with our website and other websites. You may opt out of interest-based advertising through the Digital Advertising Alliance’s opt-out page at optout.aboutads.info or the Network Advertising Initiative at optout.networkadvertising.org.

5. Cookies and tracking

We use the following categories of cookies and similar technologies. The specific tools we deploy may change; we keep this section current with the categories in use.

• Strictly necessary cookies — required for the Site to function (shopping cart, login sessions, the age-gate confirmation). These cannot be disabled.
• Analytics cookies — help us understand how visitors use the Site (for example, Google Analytics). You may opt out through your browser settings or the provider’s opt-out tools.
• Marketing and advertising cookies and pixels — used to deliver relevant advertising and measure it. You may opt out through the industry tools described above.
• Session-replay or heat-mapping tools — if we use tools that record how you interact with pages, we will list them here by category and provide an opt-out. We do not use such tools on checkout pages.

We currently do not respond to browser “Do Not Track” signals, as there is no industry-standard response. Where the California Consumer Privacy Act applies to us, we honor Global Privacy Control opt-out preference signals as a request to opt out of sale or sharing.

6. How we share information

Service providers. We share information with service providers that help us operate our business, including website hosting providers, payment processors, shipping carriers, identity-verification services (where used), marketing platforms, and analytics providers. These providers are contractually obligated to use your information only as directed by us and consistent with this Policy.

Business transfers. If Mello Tabs LLC is involved in a merger, acquisition, asset sale, or financing transaction, your information may be transferred as part of that transaction. We will provide notice before your personal information becomes subject to a materially different privacy policy.

Legal compliance. We may disclose information if required by law or in response to valid legal requests such as subpoenas, court orders, or government inquiries, or to protect the rights, property, or safety of Mello Tabs, our users, or others.

With your consent. We may share information with third parties when you give explicit consent.

7. Your privacy rights and choices

All users

• Opt out of promotional emails using the unsubscribe link in those emails. You will still receive transactional communications related to your orders or account.
• Opt out of marketing text messages at any time by replying STOP.
• Control cookies through your browser settings. Disabling certain cookies may affect parts of our Services.
• Contact us at [email protected] to request access to, correction of, or deletion of personal information we hold about you, subject to applicable law and exceptions for legal compliance and legitimate business purposes.

California resident rights

If you are a California resident and the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), applies to us, you have the right to know the categories and specific pieces of personal information we have collected about you, the categories of sources, and the purposes for which it is used or disclosed; the right to delete personal information we have collected from you, subject to exceptions; the right to correct inaccurate personal information; the right to opt out of sale or sharing (we do not sell personal information for money, but sharing with advertising or analytics partners may qualify, and you may opt out by contacting us or by using the industry opt-out tools above, and we honor Global Privacy Control signals); and the right not to be discriminated against for exercising these rights. Whether the CCPA applies to us depends on thresholds we assess annually; whether or not it applies, we will honor the requests above to the extent applicable law provides and respond to verified requests within the time the law allows.

Other state privacy rights

Residents of Colorado, Connecticut, Virginia, Texas, and other states with comprehensive privacy laws may have similar rights to access, correct, delete, and opt out of certain uses of their personal information. Those laws also apply on thresholds we assess annually. 8. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect from unauthorized access, use, disclosure, or destruction, and we dispose of records containing personal information securely when they are no longer needed. No system can be guaranteed completely secure. If a security breach affects your personal information, we will notify you and the applicable authorities as required by law, including the North Carolina Identity Theft Protection Act.

9. Children’s privacy

Our Services are not directed to individuals under the age of 21. Our products contain hemp-derived cannabinoids and are sold only to adults. We do not knowingly collect personal information from individuals under 21. In compliance with the Children’s Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13; if we learn that we have, we will delete it promptly. 10. Third-party websites

Our Services may contain links to third-party websites or services that we do not own or control. We are not responsible for their privacy practices and encourage you to review their privacy policies before providing personal information.

11. United States only

Our Services are operated in the United States and are offered to United States residents only. We do not ship outside the United States and do not offer international transfer mechanisms. If you access our Services from outside the United States, your information will be processed in the United States.

12. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with a new effective date and, where appropriate, communicated by email or a notice on our website before they take effect. The “Last updated” and “Effective date” lines at the top of this page identify the current version; we retain prior versions and their effective dates.
